Additional Information Regarding Terms of Use

1. Agreement to Terms

By accessing or using any product or service operated by Shepherd Apps LLC ("we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"). These Terms apply to all of our products and services (collectively, the "Services"):

• Called & Committed (calledandcommitted.com) — Business management platform for Christian entrepreneurs
• ServantHub — Volunteer and event scheduling platform for churches and ministries
• Play Life Canvas (playlifecanvas.com) — Life simulation game
• FaithQuest — Christian knowledge educational game
• Other similar digital products

If you do not agree to these Terms, please do not use our Services or purchase our Products.

2. Description of Services

2.1 Called & Committed

A business management platform designed for Christian founders and small-business owners. Features include vision planning, goal tracking, project management, sales pipeline, marketing calendar, stewardship-based budgeting, weekly reviews, decision journaling, ethical business checklists, prayer and reflection, and AI-powered business coaching.

2.2 ServantHub

A volunteer and event scheduling platform for churches and ministries. Features include member management (names, email addresses), volunteer scheduling, event coordination, and training/class tracking.

2.3 Play Life Canvas

A life simulation game where players make life-changing decisions that shape their character's journey. Available in a free version with limited gameplay and a premium version with extended content.

2.4 FaithQuest

A Christian knowledge educational game designed to test and grow biblical understanding. Available in a free version with limited gameplay and a premium version with extended content.

3. User Accounts

To use certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Update your information to keep it accurate and current

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

4. Subscription Plans and Pricing

4.1 Called & Committed

• Monthly Plan: $19.99 per month, billed monthly
• Annual Plan: $199 per year, billed annually (savings of $40.00)
• All plans include a 14-day free trial

4.2 ServantHub

Pricing for ServantHub is available on the ServantHub website. Subscription terms follow the same general policies outlined in this section.

4.3 Play Life Canvas & FaithQuest

• Free Version: Core gameplay available at no cost with limited content
• Premium Version: One-time or recurring purchase via Stripe to unlock extended gameplay and additional content
• Pricing is displayed at the point of purchase within the application

5. Free Trial Terms

Where offered (currently Called & Committed), free trials are subject to the following terms:

• Trial duration is 14 days from the date of account creation.
• During the trial, you have full access to all features of the Service.
• At the end of the trial period, access to premium features will be restricted until you subscribe to a paid plan.
• No payment information is required to start a free trial.
• You will not be automatically charged at the end of the trial. You must actively choose to subscribe.
• Trial periods cannot be extended, paused, or restarted.
• We reserve the right to modify or discontinue free trials at any time.

6. Billing, Cancellation, and Refunds

6.1 Billing

• All payments are processed securely through Stripe, Inc.
• By subscribing or making a purchase, you authorize us to charge your chosen payment method on a recurring basis (for subscriptions) or as a one-time charge (for game purchases).
• Subscription billing occurs at the beginning of each billing cycle (monthly or annually).
• Failed payments will be retried according to Stripe's retry schedule. If payment cannot be collected, your subscription may be suspended.

6.2 Cancellation

• You may cancel your subscription at any time through the Billing page or Stripe Customer Portal.
• Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date.
• No partial refunds are issued for unused time within a billing period.
• After cancellation, your account and data remain accessible in a read-only state for 30 days, after which data may be deleted.

6.3 Refunds

• Subscription refunds are handled on a case-by-case basis at our discretion.
• Refund requests must be submitted within 7 days of the charge to [email protected].
• One-time game purchases (Play Life Canvas, FaithQuest) are generally non-refundable once content has been accessed.
• If you experience technical issues preventing access to purchased content, contact [email protected] for assistance.

7. In-App Purchases (Play Life Canvas & FaithQuest)

• Premium content is unlocked through one-time or recurring purchases processed via Stripe.
• All prices are displayed in USD and include applicable taxes where required.
• Purchases are tied to your account and are non-transferable.
• Premium content access requires an active internet connection and valid account.
• We reserve the right to modify pricing for future purchases (existing purchases are not affected).
• If a game is discontinued, we will provide at least 90 days notice and ensure purchased content remains accessible during that period.

8. Service Availability and Uptime

• We strive to maintain 99.5% uptime for all Services, excluding scheduled maintenance.
• Scheduled maintenance will be announced at least 24 hours in advance when possible.
• We are not liable for interruptions caused by: internet service provider failures, force majeure events, third-party service outages, or circumstances beyond our reasonable control.
• In the event of extended unplanned downtime (exceeding 72 consecutive hours), affected subscribers may request a pro-rated credit for the downtime period.
• We do not guarantee that the Services will be error-free or uninterrupted at all times.

9. Data Ownership

• You retain full ownership of all content you create, upload, or input into our Services ("Your Content").
• By using our Services, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Services to you.
• We do not claim ownership of Your Content and will not use it for purposes unrelated to providing the Services.
• You may export or request a copy of Your Content at any time by contacting [email protected].
• Upon account deletion, Your Content will be permanently removed within 30 days (except where retention is required by law).

10. Acceptable Use

You agree to use our Services only for lawful purposes. You agree not to:

• Use the Services in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Services or other users' accounts
• Interfere with or disrupt the Services, servers, or networks
• Transmit harmful, offensive, or inappropriate content
• Use the Services to send spam, phishing, or unsolicited communications
• Reverse engineer, decompile, or attempt to extract the source code of the Services
• Resell, redistribute, or sublicense the Services without our written permission
• Use automated tools (bots, scrapers) to access the Services without authorization

11. Intellectual Property

The Services and their original content, features, functionality, design, and branding are owned by Shepherd Apps LLC and are protected by copyright, trademark, and other intellectual property laws. This includes but is not limited to: software code, user interface designs, graphics, logos, and written content.

You may not copy, modify, distribute, or create derivative works based on our Services without our express written permission.

12. AI Business Coach Disclaimer (Called & Committed)

The AI Business Coach feature provides general business guidance informed by biblical principles. Important limitations:

• AI-generated advice is for informational and inspirational purposes only.
• It is not a substitute for professional legal, financial, tax, accounting, or medical advice.
• We make no guarantees about the accuracy, completeness, or suitability of AI-generated advice.
• You should consult qualified professionals before making significant business, financial, or legal decisions.
• We are not liable for any actions taken based on AI coach recommendations.

13. Account Termination

13.1 Termination by You

You may close your account at any time by contacting [email protected]. Upon closure, your subscription (if any) will be cancelled and your data will be handled according to our data retention policy.

13.2 Termination by Us

We may terminate or suspend your account and access to the Services immediately, without prior notice, if:

• You violate these Terms or our Acceptable Use policy
• Your conduct is harmful to other users, us, or third parties
• Your account is used for fraudulent or illegal activity
• Required by law or legal process

In cases of termination for cause, no refund will be issued. We will make reasonable efforts to notify you and provide an opportunity to export your data before permanent deletion, unless prohibited by law.

14. Limitation of Liability

To the maximum extent permitted by applicable law:

• Shepherd Apps LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• We shall not be liable for any loss of profits, revenues, data, use, goodwill, or other intangible losses resulting from your use of the Services.
• Our total cumulative liability for any claims arising from or related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
• These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).

15. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

16. Indemnification

You agree to indemnify and hold harmless Shepherd Apps LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) Your Content.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on our websites with a revised "Last Updated" date
• Sending an email notification to registered users for significant changes
• Providing at least 30 days notice before material changes take effect

Your continued use of the Services after the effective date of changes constitutes acceptance of the modified Terms. If you do not agree to the updated Terms, you must stop using the Services.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or the Services shall be resolved as follows:

• Jurisdiction: If informal resolution fails, any legal action shall be brought exclusively in the state or federal courts located in the State of New York.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
